Waqf amendment Act 2025: The Supreme Court will hear the petitions filed against the Waqf Amendment Act 2025 on Wednesday (April 16, 2025). Before that another writ petition has been filed. This petition has been filed by a Sikh, whose name is Daya Singh. Daya Singh has challenged the constitutionality of the law and described the non-Muslims from stopping the wealth from donating property to Waqf. He has also objected to the government’s intervention in Waqf by referring to the autonomous legal status of the Hindu religious trust.
According to the report of Live Law, Daya Singh is the president of Gurdwara Singh Sabha of Gurugram. He claims to be a supporter of inter-religious and also claims to have charity for various religions. The petitioner says that by changing the Waqf law, preventing non-Muslims from donating property as Waqf is a violation of fundamental rights, which are protected in the Constitution. He said that this is a practice contained in Sikhism, which supports donating.
Daya Singh has filed a petition through Advocate on Record Shekhawat Psychwal. Daya Singh said, ‘The Waqf Amendment Act presents an improper classification, which has been done only on the basis of religion. It improperly restricts their autonomy, freedom of conscience and religious expression on property by preventing non-Muslims from donating for Waqf.
Daya Singh also questioned the Waqf properties being carried out under the state governments and said that the Rajs governments cannot stop the voluntary work of their donations or devotion on the basis of the religious identity of someone under the guise of regulating donations. He said that the Waqf Amendment Act is contrary to arbitrary and secular ethos inherent in the Constitution.
Daya Singh described the law as discriminatory for Muslims. He argued that the religious trusts of Hindu and Sikhs have got autonomous legal status, but this law has enhanced the government’s intervention in Muslim Waqf matters, which is a violation of Article 14 of the Constitution. He has also objected to the practice of at least 5 years of Islam is necessary to donate property to Waqf.
